Pre-Term Cleveland, Inc. v. Kasich

State court challenge to abortion restrictions passed by the legislature as part of the state’s 2014-2015 budget bill. Ohio’s Constitution includes a “one subject rule,” limiting every piece of legislation to address only a single subject and serve a single purpose. Preterm Clinic, Inc. alleges that the State violated the one subject rule by including provisions unrelated to appropriations, revenue generation or taxation in a budget bill. In September 2014, Plaintiff filed a motion for summary judgment asking the court to decide in Plaintiff’s favor and requesting a hearing on their motion. In January 2015, the state filed a motion for summary judgment and a response to plaintiff’s motion for summary judgment. On May 18, 2015, the Cuyahoga County Court of Common Pleas granted the State's motion for summary judgment on the grounds that Preterm does not have standing.
